1. Introduction

1.1. These Terms and Conditions ("Terms") govern the purchase of video clips through the clip library operated by Fixon Media Group PTY LTD (ABN 84 658 083 919) ("Fixon Media", "we", "us", "our") at library.fixonmedia.com.au (the "Site").

1.2. By completing a purchase on the Site, you ("you", "purchaser") agree to be bound by these Terms.

1.3. These Terms should be read alongside our Privacy Policy and Safeguarding Policy, both available on the Site.

2. Definitions

2.1. "Clip" means an individual video file made available for purchase on the Site.

2.2. "Athlete" means the individual whose likeness appears in a Clip.

2.3. "Personal Licence" means the licence granted to a purchaser under clause 5 of these Terms.

2.4. "Partner Organisation" means the sporting body, league, club, school, university or event organiser under whose event the footage comprising a Clip was captured.

2.5. "Bundle" means a fixed-quantity purchase of 5, 10 or 20 Clips at a bundled price.

3. Who Can Purchase

3.1. By completing a purchase, you confirm that you are either: (a) the Athlete shown in the Clip; or (b) the parent or legal guardian of the Athlete shown in the Clip.

3.2. This confirmation relates to the primary subject of the Clip. It does not require you to identify or obtain consent from any other person who may incidentally appear in the Clip, which is unavoidable in footage of mass-participation sporting events.

3.3. You must not purchase a Clip on behalf of, or for the benefit of, any third party who is not the Athlete or the Athlete's parent or legal guardian, including a sponsor, brand, club, or commercial entity. Where a business or organisation requires footage of an Athlete for its own purposes, refer to clause 7 (Commercial and Editorial Use).

3.4. It is your responsibility to satisfy yourself, before completing a purchase, that the Clip shown is the Clip you intend to purchase. Clips are tagged manually and, while we take care in doing so, tagging errors can occur. See clause 9 (Refunds) for how this is handled.

4. Ordering And Payment

4.1. Clips may be purchased individually, or as a Bundle of 5, 10 or 20 Clips at a bundled price. A Bundle is a one-time purchase for that specific quantity of Clips selected at checkout; it is not a credit balance and does not carry forward to future purchases.

4.2. Prices are displayed in Australian dollars and are exclusive of GST unless otherwise stated.

4.3. Payment is processed by Stripe. We do not collect or store your payment card details.

4.4. No account is required to purchase. Purchases are processed as guest checkouts.

5. Personal Licence

5.1. On completion of a purchase, we grant you a perpetual, non-exclusive, non-transferable Personal Licence to use the purchased Clip for: (a) personal and family archival purposes; (b) posting to your own social media accounts, or, where you are a parent or guardian, your child's social media accounts; (c) editing the Clip as you see fit for the above purposes, including cropping, adding music, overlays, or other modifications, and sharing the edited version; and (d) use by the Athlete for their own personal commercial benefit as an athlete, including fulfilling their own sponsorship or endorsement obligations.

5.2. The Personal Licence does not permit: (a) resale, re-licensing, or sublicensing of the Clip to any other party; (b) use of the Clip by a sponsor, brand, club, or any third party to promote that third party's own products, services, or brand (for example, a sponsor using the Clip to promote its association with the Athlete); or (c) any broadcast, editorial, or commercial use beyond that described in clause 5.1(d).

5.3. All copyright and other intellectual property rights in the Clip remain with Fixon Media at all times. The Personal Licence is a right to use the Clip as set out above, not a transfer of ownership.

6. Delivery

6.1. On completion of purchase, you will receive a download link to the purchased Clip(s).

6.2. The download link remains active for 7 days from the time of purchase. It is your responsibility to download your Clip(s) within this period. We recommend downloading and backing up your Clip(s) promptly after purchase.

6.3. If your download link expires before you have downloaded your Clip(s), contact us at didier@fixonmedia.com.au and we will consider reissuing access at our discretion.

7. Commercial And Editorial Use

7.1. The Personal Licence does not cover commercial use (beyond clause 5.1(d)) or editorial use of a Clip.

7.2. If you require a commercial or editorial licence - for example, use by a sponsor, brand, media outlet, or other third party - contact us at didier@fixonmedia.com.au to discuss a separate licence and pricing. Commercial and editorial licences are not available for purchase directly through the Site.

8. Removal Of Clips From Sale

8.1. Clips may be removed from sale at any time in accordance with our Safeguarding Policy, including at the request of the Athlete or their parent or legal guardian.

8.2. Removal of a Clip from sale does not affect a Personal Licence already granted for a completed purchase of that Clip.

9. Refunds

9.1. Clips are digital products delivered immediately on purchase. Once a Clip has been downloaded, no refund will be provided.

9.2. It is the purchaser's responsibility to ensure they are purchasing the correct Clip before completing checkout. We are not liable for a purchase made in error where the Clip delivered matches the Clip selected at checkout.

9.3. Where a genuine tagging error on our part results in a Clip being delivered that does not match its listing (for example, footage of a different Athlete than the one named), contact us at didier@fixonmedia.com.au and we will provide a replacement or refund at our discretion.

9.4. Nothing in this clause excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

10. Availability And Accuracy

10.1. Clips are made available on a best-efforts basis. We do not guarantee that any particular Clip of an Athlete exists or will be available for purchase.

10.2. Athlete names, event names and categories associated with each Clip are sourced from the relevant Partner Organisation's data and tagged manually. While we take reasonable care, we do not guarantee the accuracy of this tagging.

11. Limitation Of Liability

11.1. To the maximum extent permitted by law, our total liability to you arising out of or in connection with a purchase is limited to the amount paid by you for the Clip or Bundle giving rise to the liability.

11.2. To the maximum extent permitted by law, we are not liable for any indirect, special or consequential loss arising from your purchase or use of a Clip.

11.3. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

12. Intellectual Property

12.1. All Clips are filmed by Fixon Media staff or contractors. Fixon Media owns all copyright in the Clips, subject only to the Personal Licence (or any separately agreed commercial or editorial licence) granted to a purchaser.

13. Governing Law

13.1. These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.

14. Changes To These Terms

14.1. We may update these Terms from time to time. The version in effect at the time of your purchase applies to that purchase. The current version is always available on the Site.
