1. Introduction

1.1. Fixon Media Group PTY LTD (ABN 84 658 083 919) ("Fixon Media", "we", "us", "our") operates the clip library at library.fixonmedia.com.au, through which athletes and their families can purchase personal-licence video clips.

1.2. We are committed to handling personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).

1.3. This Policy explains what personal information we collect, how we collect it, what we use it for, who we disclose it to, and how you can access, correct, or ask us to delete it.

1.4. This Policy should be read alongside our Terms and Conditions and Safeguarding Policy.

2. What Personal Information We Collect

2.1. Athlete information: The clip library holds athlete names, and associated event and category information, so that clips can be searched and matched to the athlete shown. This information is derived from the sporting body, club, league or event organiser that engaged Fixon Media to film the event ("Partner Organisation") - typically from event entry lists, results or competitor data - and is not separately collected by Fixon Media from the athlete.

2.2. Purchaser information: When a purchase is made, our payment processor, Stripe, collects the purchaser's name, email address, phone number, and billing address. Fixon Media retains a record of this information as part of the transaction.

2.3. Correspondence: If you contact us - including to request a clip be removed, or to make a privacy, access or complaint request - we collect the information you provide in that correspondence, such as your name and email address.

2.4. We do not require account creation, and we do not collect or store passwords or user profiles.

2.5. We do not currently use website analytics or tracking tools. If this changes in future (for example, to understand site usage), we will update this Policy accordingly before doing so.

3. How We Collect Personal Information

3.1. Athlete information is provided to us by the relevant Partner Organisation for the purpose of filming and operating the clip library, under our agreement with that Partner Organisation.

3.2. Purchaser information is collected directly from the purchaser at the point of checkout, via Stripe.

3.3. Correspondence information is collected directly from the person contacting us.

4. Why We Collect, Hold And Use Personal Information

4.1. We use personal information to: (a) enable athletes and their families to search for and identify clips featuring a particular athlete; (b) process purchases and deliver purchased clips; (c) respond to correspondence, including removal requests, access requests, and complaints; (d) send transactional communications relating to a purchase (e.g. receipts, download links); and (e) with consent, send marketing communications about the clip library.

4.2. We do not use athlete or purchaser information for any purpose other than those set out above.

5. Disclosure Of Personal Information

5.1. Payment processing: Purchaser information is collected and processed by Stripe. Stripe's handling of this information is governed by Stripe's own privacy policy.

5.2. Transactional email: Purchaser email addresses are provided to Resend, our email delivery provider, for the purpose of sending transactional emails (such as receipts and download links).

5.3. Marketing email: If we introduce a marketing or newsletter platform (such as Mailchimp) in future, purchaser email addresses used for that purpose will only be provided to that platform where the purchaser has opted in to marketing communications, and this Policy will be updated to name the platform in use.

5.4. Video hosting: Clip footage is stored using Cloudflare's infrastructure.

5.5. We do not share athlete or purchaser information with any Partner Organisation (including the Victorian Athletic League) for that organisation's own marketing or other purposes.

5.6. We do not sell personal information to any third party.

6. Overseas Storage And Disclosure

6.1. Some of the services we use to operate the clip library - including Stripe, Resend, and Cloudflare - operate infrastructure located outside Australia, including in the United States. This means personal information may be stored on, or transmitted through, servers located overseas.

6.2. Where personal information is handled by an overseas provider, we take reasonable steps to ensure that provider handles the information in a manner consistent with the Australian Privacy Principles, including by relying on the provider's own published privacy and security practices.

7. Storage & Security

7.1. We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure, including by relying on the security measures of the third-party platforms named in this Policy.

7.2. No method of electronic storage or transmission is completely secure. While we take reasonable steps to protect personal information, we cannot guarantee its absolute security.

8. Retention

8.1. Purchaser information (including name, email, phone, and billing address) is retained indefinitely, for the life of the clip library and Fixon Media's business, to support ongoing customer service, licence verification, and record-keeping.

8.2. Athlete information (name, event, category) is retained for as long as the associated clip remains available, or is intended to remain available, through the clip library.

8.3. Where a clip is removed from sale under our Safeguarding Policy, associated athlete information may still be retained where necessary for record-keeping of the removal itself, but will not continue to be used to make the clip searchable or available for purchase.

9. Marketing Communications

9.1. We may retain your email address to send you information about the clip library, including new content, offers, or related services, where you have not opted out.

9.2. Marketing communications will include a clear option to unsubscribe or opt out. This is separate from transactional communications (such as purchase receipts and download links), which relate to a completed transaction and cannot be opted out of while that transaction is being fulfilled.

10. Athletes Under 18

10.1. Where a clip features an athlete under 18, the athlete's name and associated event information is made searchable on the same basis as for adult athletes, sourced from Partner Organisation data as described in section 2.1.

10.2. A parent or legal guardian of an athlete under 18 may request access to, correction of, or removal of information relating to that athlete by contacting us using the details in section 12.

10.3. Requests relating to a clip's availability for sale (rather than the underlying information) are handled under our Safeguarding Policy.

11. Access, Correction, Complaints

11.1. You may request access to, or correction of, personal information we hold about you (or, where you are a parent or guardian, about your child) by contacting us using the details below.

11.2. We will respond to access and correction requests within a reasonable timeframe, and will advise you if we are unable to action a request and why.

11.3. If you have a concern or complaint about how we have handled personal information, please contact us in the first instance. We will investigate and respond within a reasonable timeframe.

11.4. If you are not satisfied with our response, you may make a complaint to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
