1. Introduction

1.1. Fixon Media Group PTY LTD (ABN 84 658 083 919) ("Fixon Media", "we", "us", "our") operates a clip library store enabling athletes and their families to purchase personal-licence video clips of themselves competing in sporting events that Fixon Media has been engaged to film.

1.2. This Policy sets out how Fixon Media approaches the safety, dignity and wellbeing of athletes, particularly athletes under the age of 18, in the sourcing, tagging, listing and sale of footage through the clip library.

1.3. This Policy operates alongside, and does not replace, the child safety, photography and code of conduct policies of the sporting bodies and event organisers Fixon Media is engaged by. Where Fixon Media films an event on behalf of a sporting body, club or competition ("Partner Organisation"), the filming itself is conducted under the Partner Organisation's own consent and safeguarding framework. This Policy addresses the additional layer of responsibility that applies once that footage is made available for individual commercial sale.

2. Policy Statement

2.1. Fixon Media is committed to ensuring that the health, safety, dignity and wellbeing of athletes, particularly children, takes priority over commercial considerations in the operation of the clip library.

2.2. Fixon Media has a zero-tolerance approach to any content, conduct or commercial practice that could expose a child to harm, exploitation or loss of dignity.

2.3. Fixon Media recognises that footage of children may appear across any event, category or division, including events that are not specifically age-restricted, and applies the standards in this Policy accordingly.

3. Scope

3.1. This Policy applies to all footage captured by Fixon Media staff and contractors for the purpose of the clip library, and to all personnel involved in filming, editing, tagging, listing and moderating that footage.

3.2. This Policy applies regardless of the age category of the event a clip is drawn from. Fixon Media does not treat age-restricted events (e.g. U14, U18) as the only source of footage of minors, and recognises that athletes under 18 may compete in open-age events.

3.3. This Policy applies to all Partner Organisations Fixon Media is engaged by, across all sports and event types the clip library may in future support.

4. Definitions

4.1. "Child" or "Minor" means a person under the age of 18 years.

4.2. "Athlete" means any individual whose likeness appears in footage made available through the clip library. The safeguards in this Policy relating to content standards (section 6) and removal rights (section 8) apply to any identifiable athlete in a clip. The purchase mechanism in section 7 concerns only the primary subject of a clip, consistent with clause 7.2.

4.3. "Partner Organisation" means the sporting body, league, club, school, university or event organiser that engages Fixon Media to film an event, and under whose registration and consent processes the original filming takes place.

4.4. "Personal licence" means the licence granted to a purchaser under the clip library's Terms and Conditions, permitting personal, archival, social media and personal-commercial use (e.g. an athlete fulfilling their own sponsorship obligations), but not resale, re-licensing, or use by a third party (including a sponsor or brand) to promote its own products or services.

4.5. "Listing" means making a clip available for purchase on the clip library.

5. Reliance On Partner Organisation Consent

5.1. Fixon Media films events strictly within the scope of its engagement with each Partner Organisation, and in accordance with that Partner Organisation's own child safety, photography and code of conduct policies.

5.2. Before any footage from a Partner Organisation's events is made available through the clip library, Fixon Media will seek written confirmation from that Partner Organisation that: (a) its existing athlete registration and consent processes extend to commercial third-party sale of footage to individual athletes and their families; or (b) where they do not, an additional consent step will be agreed between Fixon Media and the Partner Organisation before any footage from that Partner Organisation is listed.

5.3. Fixon Media does not independently verify the age or identity of any athlete appearing in footage. Fixon Media relies on the Partner Organisation's own registration, categorisation and consent processes for this purpose. This Policy's safeguards are designed to operate on that basis, without requiring independent age verification by Fixon Media.

6. Content Standard For Listing

6.1. Fixon Media applies a single dignity and appropriateness standard to all footage considered for listing, regardless of the age of the athlete, the event category, or whether the event is age-restricted or open. This approach is deliberate: because minors may appear in any event, Fixon Media does not rely on event category to determine whether extra care is required, and instead applies a standard suitable for all athletes, including minors, to everything it lists.

6.2. Footage will not be listed for sale where it: (a) compromises the dignity of the athlete, including but not limited to rear-angle or similarly framed shots that focus on the body rather than the athletic performance; (b) shows the athlete in visible distress, injury, or a moment of physical or emotional vulnerability unrelated to ordinary athletic effort; (c) could reasonably be perceived as sexualising the athlete.

6.3. Clips are tagged manually by Fixon Media staff at the point of upload, by athlete name, event and category. This standard is applied by staff as part of that same process.

6.4. No clip is listed for sale by default. A clip only becomes available for purchase once it has passed manual tagging and the content standard in this section. Where a staff member is uncertain whether a clip meets this standard, the clip must not be listed until reviewed by Didier Le Miere.

7. Purchase And Identity

7.1. The clip library does not require purchaser accounts and does not independently verify the identity, age or relationship of any purchaser to the athlete shown in a clip.

7.2. At the point of purchase, the purchaser must confirm that they are either the athlete shown in the clip, or the parent or legal guardian of the athlete shown in the clip. This confirmation applies to the primary subject of the clip; it does not require every incidentally visible person in the background of the footage (which is unavoidable in mass-participation events) to be separately identified or consented to by the purchaser.

7.3. This confirmation is set out in full in the clip library's Terms and Conditions.

8. Removal Requests

8.1. Any athlete, or the parent or legal guardian of an athlete, may request that a clip be removed from sale at any time, for any reason, including where no breach of this Policy has occurred.

8.2. Removal requests are made to didier@fixonmedia.com.au and will be actioned promptly, without requiring proof of identity or guardianship.

8.3. Where age or identity cannot be confirmed and a concern is raised about a clip, the clip will be removed from sale pending review, rather than left listed while the matter is resolved.

8.4. Removal from sale does not affect purchases already completed prior to the removal request, which remain subject to the personal licence already granted.

8.5. How long removed or unlisted footage is retained, and when it is deleted, is set out in the clip library's Privacy Policy.

9. Reporting Concerns

9.1. Any concern regarding the safety, wellbeing or appropriate treatment of a child in connection with the clip library, including concerns about a specific clip, the conduct of Fixon Media staff or contractors, or any other matter, should be directed to Didier Le Miere at didier@fixonmedia.com.au.

9.2. All concerns will be treated seriously, investigated, and handled with appropriate confidentiality.

9.3. Where a concern raises a reasonable belief that a child is at risk of harm, Fixon Media will contact the relevant Partner Organisation and, where appropriate, the police or the relevant child protection authority in the applicable jurisdiction, without delay.

9.4. Fixon Media will not penalise any staff member, contractor, athlete or member of the public for raising a concern in good faith.

10. Staff And Contractor Responsibilities

10.1. All Fixon Media staff and contractors involved in filming, editing, tagging or listing clip library content must: (a) be familiar with this Policy and apply the content standard in section 6 at the point of tagging; (b) hold a current Working with Children Check, regardless of whether their specific role involves direct filming at an event. Staff or contractors without a valid Working with Children Check will not be engaged on any clip library work until one is provided; and (c) raise any uncertainty about a clip with Didier Le Miere prior to listing, rather than defaulting to listing it.

11. Review

11.1. This Policy will be reviewed annually, and earlier if required following a reportable concern, a change in the sporting bodies or event types Fixon Media films for, or a material change to the clip library's operation.
